This bill is in the first step in the legislative process. Introduced bills go first to committees that deliberate, investigate, and revise them before they go to general debate. The majority of bills never make it out of committee. Keep in mind that sometimes the text of one bill is incorporated into another bill, and in those cases the original bill, as it would appear here, would seem to be abandoned. Nov 6, 2008 1:54 PM - How will this bill effect folks in the criminal justice field that are not police officers? (prosecutors, attorneys, corrections, probation, ect) - Read Answers
Answered by a visitor on Nov 6, 2008 4:28 PM - you would be treated like everyone else, this alos covers police officers, the industry is banned from selling new arms to the public. LE Agencies can still purchase and issue as needed to LEOs, but that is it. The LE agency owns them and must account form them appropriately.
Answered by a visitor on Nov 7, 2008 11:09 AM - A police department may make the purchases using department letterhead just as they do with full-auto (class III) weaponry. A police officer may not privately purchase weapons defined under the proposed AWB. Those in the criminal justice field are civilians; as such they will be restricted in the purchase of aforementioned firearms just like anyone else.

Nov 7, 2008 10:40 PM - The second amendment clearly states "... the right of the people to keep and bear arms shall not be INFRINGED." (emphasis mine) How can this bill be considered anything but an infringment of our civil rights? If this were to pass the ability of the people to own a particular firearm would most definately be infringed upon. - Answer it!

That should be the complete list of GUNS and if I missed some of them... apologies to the board.

You can go to the above LINK and find more information about the GUNS and this HR 6257 Assault Weapons Ban 2008 that was proposed by Republicans.

Their NAMES are on this list. First or second post.

    Overview
    Sponsor:
    Rep. Mark Kirk [R-IL]hide cosponsors
    Cosponsors [as of 2008-11-07]
    Rep. Ileana Ros-Lehtinen [R-FL]
    Rep. Michael Ferguson [R-NJ]
    Rep. Christopher Shays [R-CT]
    Rep. Michael Castle [R-DE]

You can find the Democrats listed all over for ANTI GUN laws and bans - same as with these Republicans.

    Thank you.

I wrote about this last summer when this was introduced and I think that I put it up on the old THR board. Perhaps a link - I can't remember now - it did not get too much attention! Go figure! Just like the other STUFF that has now come true but was 'not allowed' when it came to something financial back spring/summer.

I do KNOW that I wrote about it elsewhere. I spoke about it among other things in the RKBA issue.

So to prove the point... BOTH sides (R&D) will screw you with ANTI GUN and ANTI freedom issues!!!

    Gun and financial control = C O N T R O L! Period!

Without blinking an eye and looking over the ENTIRE LIST - I have several firearms that are on this list.

    One is sold. Winchester 94-22

I have several lever action rifles and 1 semi automatic rifle.

    Browning BL22
    Marlin 39A
    Marlin Papoose
    Etc. = in 22LR alone.

I did not list center fire rifles and/or handguns in various calibers and styles!

I can't even begin to list my husband's and I will not.

You know that they will create a false flag event or there will be a real one just to push some other anti gun - anti freedom garbage laws. Ugh.

Just because you're paranoid - does not mean that they are not out to get you! ; . )

    Please note:

This bill was introduced by a Republican. This doesn't mean we should be happy, but it does mean that it looks "better" than the Dem bill will look:

    1. It expires 10 years after enactment. (A non-expiring, permanent ban is what Obama is on record as wanting).
    2. All firearms listed in Appendix A are EXEMPTED.

Not sure why this bill was introduced at the time it was. But be sure that it will be amended into a much worse bill.

And I'm pretty sure it will have to be re-introduced (in far more unConstitutional form) in the new Congress.

SEC. 2. RESTRICTION ON MANUFACTURE, TRANSFER, AND POSSESSION OF CERTAIN SEMIAUTOMATIC ASSAULT WEAPONS.

    (a) RESTRICTION- Section 922 of title 18, United States Code, is amended by adding after subsection (u) the following:
‘(v)(1) It shall be unlawful for a person to manufacture, transfer, or possess a semiautomatic assault weapon.
‘(2) Paragraph (1) shall not apply to the possession or transfer of any semiautomatic assault weapon otherwise lawfully possessed under Federal law on the date of the enactment of this subsection.
‘(3) Paragraph (1) shall not apply to--
    ‘(A) any of the firearms, or replicas or duplicates of the firearms, specified in appendix A to this section, as such firearms were manufactured on October 1, 1993;

Does 3A mean that, if the features of the listed firearms had not been modified in the course of post-1994 production by the manufacturer, those firearms are excluded from the ban?

It should also be noted that all of the Republicans that authored and co sponsered this bill are all moderates. They are not conservatives and they have bad anti gun records. These guys are not an accurate sample that is represenatative of the party and their position on gun rights. By and large, the GOP is pro gun. I think it's appropriate to call out these gun grabbing Republicans, but I think it's too broad a stroke to label all or even the majority of the GOP as gun grabbers when in fact, the opposite is true.

To consider both parties equal, with respect to gun control or most other issues, would be grossly innaccurate. It also breeds the kind of chaos that gets someone like BO elected.

But of course, some Republicans will sway to the left, usually in urban districts. Some rural Dems have been good to gun owners but as a whole, not so much.

So I hope the OP's point is that you need to vote for the man and not the party and not that both parties are equally bad to us. Or maybe I missed the point altogether. Whoosh!

    Is this bill advancing?

It's identical to the 1994 ban and it isn't going anywhere.

It doesn't matter Gunsby. As the very astute GigaBuist stated:

It's identical to the 1994 ban and it isn't going anywhere.
Not that we shouldn't be ever vigilant. But the memories of the 1994 Democatic meltdown, losing Congress for 10 years and costing Gore the WH in 2000 are still very fresh.
As I said in another space, they won't make that mistake again. Not this quickly.
Gun issues will be moved to the back burner for now, to give that boiling frog a lot more time to simmer.
